What is a living trust?
A living trust is a formal written document that you sign that creates a new legal entity, “the trust”, which you own and control while you are alive.
How does a living trust avoid probate?
To avoid probate, you simply transfer ownership of your assets to your living trust and then the trust, not you, owns the assets when you die so that none of the assets in the trust go through the probate process.
